Roll call showed the following members present on this date at 6:30 p.m. Burnell, Parker, Schwartz, Richter, Kuck and Kronenberger. Also present were Mayor Pape, Solicitor Smith, First Sergeant Pyles, Village Administrator York and Fiscal Officer Gast.
Visitors were Mike Hibner, Ben Krieg and Andrew Wilson representing The Evening Leader.
Minutes from the February 22, 24 and March 2 meetings were approved with the following change to March 2: Page 1, paragraph 2, line 1 add Dennis Burnell. Motion by Kuck. Second by Richter. All ayes.
Mayor Pape made the following announcements in his Mayor’s Report:
- Reported fines, fees and forfeitures for February in the amount of $1742.00.
- Announced New Bremen Tree City USA for the 20th year along with the 2015 Growth Award.
- Announced Spring Clean Up Day to be held on April 30.
- Statewide Tornado Awareness test to be March 23 at 9:50 a.m.
- Village Administrator York updated Council on his attendance at the Legislative Rally in Washington, DC; announced the bid opening for the Parks building to be March 17 at 2:00 p.m.; reported on Library repairs and the Circle Drive Project.
Council briefly discussed locking the new restroom at Komminsk Legacy Park at night. Council also discussed the formation of a sled hill at Bremenfest Park. Village Administrator York will stake out the location. Council will review both issues further and discuss at the next meeting.
First reading RESOLUTION 2016-3-17 authorizing Change Order #1 in the amount of $2,421 to Schmiesing Tree Service for additional trees removed with rotting branches and canopies and trees causing future liabilities from poor root attachment and structure along the Miami & Erie Canal Towpath. Motion by Kronenberger. Second by Richter. All ayes.
First reading RESOLUTION 2016-3-16 authorizing Change Order #7 from H.A. Dorsten in the amount of $20,718.28. The change is for labor, material and equipment to install 72 feet of stainless steel trench drain at the Komminsk Legacy Park at a cost of $14,960 and a tent and temporary heat at a cost of $5,758.28. Council asked for more details concerning the change order. Motion by Kuck. Second by Schwartz. All ayes.
First reading RESOLUTION 2016-3-18 authorizing Change Order #8 from H.A. Dorsten in the amount of $16,510 for materials and labor to change the thickness of the towpath concrete from 4” to 6” and add curb cut at Plum Street and retaining wall and ground mat seeding at Komminsk Legacy Parker. Motion by Parker. Second by Kronenberger. All ayes.
Kuck made a motion to suspend the rule. Second by Parker. All ayes. RESOLUTION 2016-3-19 accepting all bids for the $2,500,000 loan for the Public Works Building Project and awarding the bid to Minster Bank at the fixed interest rate of 1.9% for 7 years. Motion by Parker. Second by Kronenberger. All ayes.
Village Administrator York presented the bids for the Public Works Building Project. RESOLUTION 2016-3-20 accepting all bids and awarding the bid to the lowest bidder Heyne Construction, Inc., Minster, Ohio with a bid of $2,249,580. The bid was 15% under the estimate. Motion by Kuck. Second by Schwartz. All ayes.
Kuck made a motion to enter Executive Session at 7:33 p.m. to discuss personnel. Second by Schwartz. All ayes.
Council came out of Executive Session at 8:14 p.m. and took the following action. First reading RESOLUTION 2016-3-21 authorizing the Fiscal Officer to restore the sick leave used by employee Steve Bornhorst for the accident/injury that took place on July 27, 2015. There was a miscommunication about the amount of temporary total disability Bornhorst was entitled to under Workers Compensation. Council feels that Bornhorst did not have the correct facts when he made his decision to delay his payments from Workers Compensation. This credit back of sick leave is unique and will only be justified this one time. Motion by Richter. Second by Parker. All ayes.
