Roll call showed the following members present on this date at 6:30 p.m.  Burnell, Parker, Schwartz, Hoffman, Kuck and Kronenberger.  Also present were Mayor Pape, Solicitor Smith, Chief of Police Skinner, Village Administrator York and Fiscal Officer Gast.


Visitors were Brent Richter, John Freytag, Mike Hibner, Clair Giesige representing The Daily Standard and Andrew Wilson representing The Evening Leader.


Minutes from the August 24, August 31 and September 4 meetings were approved with the following change to September 4:  Page 1, paragraph 2, line 5 change non-abatement to abatement.  Motion by Kuck.  Second by Parker.  All ayes.


Mayor Pape made the following announcements in his Mayor’s Report:

  • Announced Cider Time will be Oct. 25.  Parade line-up at 1:00 p.m. at the Lockkeepers House.
  • Announced Trick or Treat will be on Oct. 29 from 6:00 p.m. to 7:30 p.m.
  • Thanked the Electric Dept. and Public Works Dept. for a good job on the Raw Water Supply Project.
  • Reported fines, fees and forfeitures for the month of August in the amount of $891.00.
  • Village Administrator York updated Council on various projects within the Village.


Second reading ORDINANCE 2015-8-14 amending CRA No. 1 to the extent that no exemption is granted for tax levies passed after October 1, 2015 where it applies to residential properties.  This will make CRA No. 1 uniform with CRA No. 2.  Since CRA No. 2 has been amended, Solicitor Smith told Council this ordinance would no longer be needed.  Motion by Burnell.  Second by Schwartz.  All nays.  This legislation failed.


Second reading RESOLUTION 2015-8-37 authorizing Change Order No. 2 to H.A Dorsten, Inc. for the Komminsk Legacy Park Project.  The change order is for general construction work including site grading, pool equipment/piping and electrical.  The total sum of the change order is $20,186.00.  The total cost of the project is $905,850.  Motion by Parker.  Second by Kronenberger.  All ayes.


Second reading RESOLUTION 2015-8-38 identifying the services that will be provided to 5.074 acres in German Township proposed for annexation on SR 66 South.  The services will include water, electric, refuse and police and fire protection.  Motion by Hoffman.  Second by Kuck.  All ayes.


John Freytag, architect for the Komminsk Legacy Park, updated Council on the changes to the restroom project.  Kuck made a motion to suspend the rule.  Second by Schwartz.  All ayes.  RESOLUTION 2015-9-39 authorizing Change Order #1 in the amount of $9,493 to Muhlenkamp Building Corporation for the restroom facility.  The order includes an additional radius handrail and other minor changes.  This would bring the total cost of the project to $513,675.  Motion by Parker.  Second by Burnell.  All ayes.


First reading RESOLUTION 2015-9-40 leasing the property at 322 S. Herman Street to the Community Improvement Corporation (CIC) for the sum of $1.00.  The CIC may use the property for short-term or transitional housing.  The lease is for one year. 


First reading ORDINANCE 2015-9-19 adopting Chapter 42 of the Codified Ordinances of the Village of New Bremen concerning municipal income tax. The change in language will ensure tax collection will be more uniform statewide starting in 2016.  Motion by Kuck.  Second by Hoffman.  All ayes.


Schwartz made a motion to enter into Executive Session at 7:35 p.m. to discuss personnel. 


Council came out of Executive Session at 8:37 p.m. and took no action.  Adjournment followed with a motion by Schwartz.  Second by Kuck.  All ayes.
