Roll call showed the following members present on this date.  Burnell, Wills, Schwartz, Hoffman, Kuck and Stienecker.  Also present were Mayor Pape, Solicitor Smith, Chief of Police Harrod and Fiscal Officer Gast. 
Visitors were Matt Krieg, Greg and Carol Dennings, Margie Wuebker representing The Daily Standard and Meredith Enkoff representing The Evening Leader.
Minutes from the February 26 meeting were approved as amended: Page 1, paragraph 10, line 6, remove Mayor Pape broke the tie with an aye.  Page 2, paragraph 3, line 4 add and increasing the total cost of the engineering for the project to $92,536.  Motion by Hoffman.  Second by Wills.  All ayes.
Mayor Pape made the following announcements in the Mayor’s Report:
- Updated Council on the interview process for the Chief of Police.
- Received a letter from the Department of Commerce, Division of Liquor Control notifying the Village that all permits to sell alcoholic beverages will expire June 1, 2013.  In order to maintain permit privileges, every permit     holder must file a renewal application.
- Council received an invitation to tour the new Brookside facility located at 200 White Mountain Drive on March 21 at 3:30 p.m.
- Announced Community Garage Sales will be April 19 and 20.
- Spring Lawn Care & Landscaping Seminar will be held on March 19th at 7:00 p.m. at the Lockkeepers House.
- Reported fines, fees and forfeitures for the month of $786.00.
Kuck made a motion to suspend the rule.  Second by Burnell.  All ayes.  ORDINANCE 2013-3-9 to amend the payroll ordinance by appointing Rob Woehrmyer as a Patrolman I Part Time, classification G-36 at a rate of $10.78 per hour.  Motion by Hoffman.  Second by Stienecker.  All ayes.
Matt Krieg, Supt. of Electric, explained Change Order #1 for the Herman Street Substation Upgrade Project. RESOLUTION 2013-3-9 authorizing a change order of $15,665.41 to Vaughn Industries with the major portion consisting of additional labor to remove extra concrete from old PCC foundation.  Motion by Wills.  Second by Kuck.  All ayes.  Krieg also updated Council on the underground project at the Lions Park.
Second reading ORDINANCE 2013-2-6 accepting the retirement of Greg Dennings, Superintendent of Water, effective March 31, 2013. Dennings told Council that he would like to continue working for the Village at his present classification and pay per hour.  Motion by Kuck. Second by Wills.  All ayes.
Second reading ORDINANCE 2013-2-7 approving the rehire of Greg Dennings, Water Superintendent, effective April 1, 2013.  Dennings will resume his duties at the same classification and rate of pay of $26.33.  Motion by Burnell.  Second by Hoffman.  All ayes.
Third reading ORDINANCE 2013-2-4 amending the Ordinance 2013-1-1 by transferring $10,000 from the Income Tax Fund to 403 Capital Projects Fund for the repayment of the 0% loan from Ohio Public Works Commission (OPWC) for the Franklin/Main Sanitary Sewer Project.  Council decided to re-pay the loan at a rate of $10,000 per year.  Motion by Burnell.  Second by Kuck.  All ayes.  
Third reading RESOLUTION 2013-2-5 amending Resolution 2012-1-2 authorizing engineering fees to Poggemeyer Design Group to include the Right-of-Way Plan for the Miami and Erie Canal Shared Trail Project in the amount of $25,974 and increasing the total cost of the engineering for the project to $92,536.  Poggemeyer Design Group has applied for a grant through the ODNR for financial assistance through the Clean Ohio Trails Fund (COTF) for reimbursement for engineering fees associated with the Miami and Erie Canal Shared Use Trail. Kuck made a motion to table the resolution until clarification could be made with the New Bremen Foundation. Second by Schwartz. All ayes.
Third reading ORDINANCE 2013-2-5 creating a new R-C Transitional Zone for certain neighborhood business uses on a case-by-case basis in residential areas that have frontage along state routes.  The proposed zone would only be for properties that have a Washington Street address.  The Planning Commission has recommended in favor of this proposed zoning at the Feb 4, 2013 public hearing.  Burnell made a motion to table the ordinance until the language could be amended to authorize the Planning Commission to decide if initially the property qualifies instead of the Board of Zoning.   Second by Schwartz.  All ayes.
Third reading RESOLUTION 2013-2-6 authorizing the Village Administrator to seek bids for the 2013-2016 Refuse Contract.  Motion by Wills.  Second by Schwartz.  All ayes.
Burnell made a motion to suspend the rule.  Second by Schwartz.  All ayes.  Second and third readings ORDINANCE 2013-2-8 authorizing the creation of a Park Advisory Board appointed by the Mayor, not to exceed seven members.  The purpose of the board is to review the needs of the parks within the Village.  Motion by Hoffman.  Second by Stienecker.  All ayes.
Burnell made a motion to suspend the rule.  Second by Wills.  All ayes.  RESOLUTION 2013-3-10 amending Resolution 2012-11-41 by pro-rating the Health Savings Account employer contribution to any 2013 newly hired employees.  Motion by Stienecker.  Second by Schwartz. All ayes.
Council briefly discussed implementing restrictions concerning Community Garage Sale activities.  No action was taken.
