Roll call showed the following members present on this date.  Burnell, Wills, Schwartz, Hoffman, Kuck and Stienecker.  Also present were Mayor Pape, Solicitor Smith, Chief of Police Harrod, Administrator York and Fiscal Officer Gast. 
 
Visitors were Katie Eyink, Flame Walk/5K, Roger Rutschilling, Joe Maurer, James Rutschilling, Greg and Carol Dennings, Margie Wuebker representing The Daily Standard and Meredith Enkoff representing The Evening Leader.
 
Minutes from the February 12 meeting were approved with a motion by Wills.  Second by Schwartz.  All ayes.
 
Wills made a motion to approve a total expenditure for the month of $694,016.18.  Second by Stienecker.  All ayes.
 
Mayor Pape made the following announcements in the Mayor’s Report:
- Updated Council on the interview process for the Chief of Police and Parks Superintendent positions.
- Burnell announced a Spring Lawn Care & Landscaping Seminar to be held on March 19th at 7:00 p.m. at the Lockkeepers House.
- Reported fines, fees and forfeitures for the month of $1180.00.
- Discussed changing the meeting dates of Council should the tournament basketball games fall on a second or fourth Tuesday.
 
Katie Eyink representing Flame Walk/5K spoke to Councilors about Flame Walk/5K, an event to raise money for the purchase of a seizure dog for a local family.  The event will take place on May 18 at 6 p.m. at the Pavilion.  For more information, go to FlameWalk.org.
 
First reading ORDINANCE 2013-2-6 accepting the retirement of Greg Dennings, Superintendent of Water, effective March 31, 2013. Dennings told Council that he would like to continue working for the Village at his present classification and pay per hour.  Motion by Wills. Second by Schwartz.  All ayes.
 
First reading ORDINANCE 2013-2-7 approving the rehire of Greg Dennings, Water Superintendent, effective April 1, 2013.  Dennings will resume his duties at the same classification and rate of pay of $26.33.  Motion by Kuck. Second by Burnell. All ayes.
 
Burnell made a motion to suspend the rule.  Second by Stienecker.  All ayes.  RESOLUTION 2013-2-8 authorizing the Village Administrator to seek bids for a truck mounted vacuum debris (leaf) collector.  Motion by Hoffman.  Second by Kuck.  All ayes.
 
Third reading Resolution 2013-1-3 authorizing the Village Administrator to seek bids for the Circle Drive Sanitary Sewer Project.  The Village received a 0% financial assistance loan from the Ohio Public Works Commission in the amount of $149,999.  Motion by Kuck.  Second by Burnell. Three ayes.  Schwartz, Kuck and Stienecker abstained.  Mayor Pape broke the tie with an aye.
 
Burnell made a motion to suspend the rule.  Second by Stienecker.  All ayes.  RESOLUTION 2013-2-7 authorizing the Village Administrator to seek bids for the Washington Street Sanitary Sewer Project.  Motion by Schwartz.  Second by Burnell.  All ayes.
 
Second reading ORDINANCE 2013-2-4 amending the Ordinance 2013-1-1 by transferring $10,000 from the Income Tax Fund to 403 Capital Projects Fund for the repayment of the 0% loan from Ohio Public Works Commission (OPWC) for the Franklin/Main Sanitary Sewer Project.  Council decided to re-pay the loan at a rate of $10,000 per year.  Motion by Wills.  Second by Hoffman.  All ayes. 
 
Second reading RESOLUTION 2013-2-5 amending Resolution 2012-1-2 authorizing engineering fees to Poggemeyer Design Group to include the Right-of-Way Plan for the Miami and Erie Canal Shared Trail Project in the amount of $25,974.  Poggemeyer Design Group has applied for a grant through the ODNR for financial assistance through the Clean Ohio Trails Fund (COTF) for reimbursement for engineering fees associated with the Miami and Erie Canal Shared Use Trail.  Motion by Kuck.  Second by Hoffman.  All ayes.
 
Second reading ORDINANCE 2013-2-5 creating a new R-C Transitional Zone for certain neighborhood business uses on a case-by-case basis in residential areas that have frontage along state routes.  The proposed zone would only be for properties that have a Washington Street address.  The Planning Commission has recommended in favor of this proposed zoning at the Feb 4, 2013 public hearing.  Motion by Kuck.  Second by Hoffman.  All ayes.
 
Second reading RESOLUTION 2013-2-6 authorizing the Village Administrator to seek bids for the 2013-2016 Refuse Contract.  Motion by Schwartz.  Second by Stienecker.  All ayes.
 
First reading ORDINANCE 2013-2-8 authorizing the creation of a Park Advisory Board appointed by the Mayor, not to exceed seven members.  The purpose of the board is to review the needs of the parks within the Village. Motion by Schwartz.  Second by Burnell.
 
Wills made a motion to enter into Executive Session to discuss personnel at 8:05 p.m.  Second by Hoffman.  All ayes.  Council came out of Executive Session at 9:14 p.m.  Adjournment followed with a motion by Schwartz. Second by Kuck.  All ayes.
