Roll call showed the following members present on this date at 6:30 p.m.  Burnell, Richter, Kuck and Kronenberger.  Kuck made a motion to excuse Parker and Schwartz.  Four ayes.  Also present were Mayor Pape, Solicitor Smith, First Sergeant Pyles, Village Administrator York and Fiscal Officer Gast.

 

Visitors were Jordan Weigandt, Dennis Wm. Dicke, Ryan Zimpfer, Benjamin Zimpfer, Claire Giesige representing The Daily Standard and Andrew Wilson representing The Evening Leader.

 

Minutes from the February 8 meeting were approved with the follow change:  Page 2, paragraph 4, line 2 change to the grass area north of the Pavilion/patio.  Motion by Kuck.  Second by Richter.  Four ayes.

 

Kronenberger made a motion to approve a total expenditure for the month of $1,082,855.15.  Second by Burnell.  Four ayes.

 

Mayor Pape made the following announcements in his Mayor’s Report:

  • Informed Council that he will contact the Boy Scouts to see if they would finish cleaning the canal as a scout project.
  • Village Administrator York updated Council on various projects within the Village.  Announced Feb. 25 at 2:00 p.m. for the bid opening for the Public Works Building.

 

The third reading RESOLUTION 2015-12-70 authorizing free participation to OhioCheckbook.com was tabled until June 13, 2016.   This is a government transparency website launched by the Ohio Treasurer’s office.  The website will display state and local government checkbook-level spending so that citizens can see how their tax money is being spent.  Fiscal Officer Gast and Solicitor Smith are concerned about income tax refund privacy which could be a potential liability.  The State of Ohio is aware of this issue.  The Village will check back with the State of Oho in June to see if the privacy concern has been addressed.  Motion by Burnell.  Second by Kronenberger.  Four ayes.

 

Third reading RESOLUTION 2016-1-5 approving Change Order #6 to H.A. Dorsten in the amount of $2523 for the Komminsk Legacy Park.  The contract change is for installing a concrete footer for grading revision at Hackberry tree.  Motion by Kronenberger.  Second by Richter.  Four ayes.

 

Third reading RESOLUTION 2016-1-6 approving Change Order #1 to Warren Pump & Supply in the amount of $540 for additional equipment for the Raw Water Supply Project.  Motion by Burnell.  Second by Kronenberger.  Four ayes.

 

Burnell made a motion to amend Resolution 2016-1-7 by adding approval upon completing of the project.  Second by Kuck.  Four ayes.  Third reading RESOLUTION 2016-1-7 approving Change Order #1 to Jackson Well Services in the amount of $5120.50 for additional equipment for the Raw Water Supply Project upon completion of the project.  Motion by Richter.  Second by Kronenberger.  Four ayes.

 

Third reading ORDINANCE 2016-1-3 authorizing an increase of daily rental for the Pavilion.  The increase will be from $100 per day to $200 per day.  Council justified the increase because of the new restroom facility and Komminsk Legacy Park.  Burnell made a motion to amend the ordinance.  Second by Kuck.  Four ayes.  The amendment will also increase the security deposit from $150 to $200 and require a certificate of insurance in the amount of $500,000 for any rental of Village property including the swimming pool.  Motion by Kronenberger.  Second by Richter.  Four ayes.

 

Second reading ORDINANCE 2016-2-6 prohibiting large inflatable apparatuses, such as bounce houses, slides etc. in the grass area north of the Pavilion/patio at the Komminsk Legacy Park.  Council feels there is a liability concern due to the terrane of the park.  Motion by Kronenberger.  Second by Richter.  Four ayes.

 

Second reading ORDINANCE 2016-2-5 amending the payroll ordinance by creating an Assistant Recreation Manager classification with the same step ranges as the Recreation Manager classification and authorizing an increase for Recreation Manager Matt McCollum to Step Range C-60.  The ordinance would also create an additional step range amount for seasonal workers.  Motion by Kuck.  Second by Richter.  Four ayes.

 

Second reading RESOLUTION 2016-12-10 identifying the services to the proposed annexation petitioned by Crown Equipment Corporation (former Tomhafe property) located at 3330 West Second Street.  Services include police and fire protection and electricity.  Water and sewer will not be provided.  Motion by Richter.  Second by Kuck.  Four ayes.

 

Second reading ORDINANCE 2016-2-7 authorizing First National Bank and Minster Bank as eligible financial institutions for designation as depositories for public monies for a period of 5 years starting April 1, 2016 through March 31, 2021 pursuant to Chapter 135.12 of the Ohio Revised Code.  Motion by Kronenberger.  Second by Burnell.  Four ayes.

 

Second reading RESOLUTION 2016-2-11 contracting with Eagon and Associates, Inc., Worthington, Ohio for a Wellhead Protection Plan in the amount not to exceed $19,000. This plan is for the new wells at the Hehr Farm.  Motion by Kronenberger.  Second by Burnell.  Four ayes.

 

First reading Resolution 2016-2-12 authorizing the purchase through the State Purchasing Program of two dump trucks for the Public Works Department from Reineke Family Dealership in the amount of $157,000.  Motion by Richter.  Second by Kronenberger.  Four ayes.

 

Burnell made a motion to suspend the rule.  Second by Kronenberger.  Four ayes.  RESOLUTION 2016-2-13 authorizing the purchase of a PVC membrane liner for the swimming pool and wading pool (material only) in the amount of $29,812 from PoolEquip.com, Indianapolis, IN.  Motion by Richter.  Second by Kronenberger.  Four ayes. 

 

Kuck made a motion to suspend the rule.  Second by Richter.  Four ayes.  RESOLUTION 2016-2-14 authorizing the installation of a PVC membrane liner for the swimming pool and wading pool (installation only) in the amount of $49,688 with an optional $8500 credit for self-removal from RenoSys Corporation, Indianapolis, IN.  Motion by Richter.  Second by Kronenberger.  Four ayes.

 

First reading RESOLUTION 2016-2-15 authorizing the purchase of a 2500 KVA Padmount transformer from Anixter, Inc. Mattoon, IL in the amount of $33,108.  Motion by Kuck.  Second by Richter.  All ayes.

 

Kronenberger made a motion to enter into Executive Session at 7:24 p.m.  Second by Burnell.  All ayes. 

 

Council came out of Executive at 7:38 p.m. and scheduled a Special Meeting for Wednesday, Feb. 24 at 5:15 p.m.  Subjects to be considered include the resignation of Village Council Member Dennis Burnell, effective Feb. 29, 2016.  The retirement system requires that he has to completely retire for him to receive maximum benefits.  Other matters to be considered are items 11, 12, 13, 14, 15 of the Feb. 22 Agenda and the purchase of a 2500 KVA transformer which received first reading on Feb. 22.
